CHRB Weekly Medication Reports
California Horse Racing Board weekly updates of complaints, accusations, stewards rulings, and Board decisions involving Class 1, 2, and 3 medication violations and other significant matters.

October 18

The stewards at Santa Anita Park issued a ruling disqualifying Scat Thief and redistributing the purse for the seventh race at Del Mar on August 3, 2008, after the Ken Maddy Laboratory at the University of California, Davis, reported that a sample taken from Scat Thief exceeded the regulatory threshold for procaine. The violation was confirmed by Truesdail Laboratories. Procaine is a local anesthetic and is found in procaine penicillin G, a commonly administered antibiotic. For this reason, procaine is a Class 3 violation rather than a Class 2 violation, as are most other anesthetics. Scat Thief finished third in the Del Mar race. The case against trainer Mike Mitchell is pending.

Pursuant to a stipulated agreement between the CHRB and trainer Jamie Gomez, the stewards at Los Alamitos fined the trainer $2,500 for violation of CHRB Rules 1843 (a) (d) and 1887 after the Maddy Laboratory reported that a sample taken from Fire Free, a horse in his care, contained fluphenazine. The Texas Veterinary Medical Diagnostic Laboratory confirmed the split sample. Fluphenazine is a human anti-psychotic drug used as a long-acting tranquilizer in horses. This is a Class 2 violation. The stewards previously disqualified Fire Free and ordered a redistribution of the purse for the 10th race at Los Alamitos on August 12, 2006, in which Fire Free finished first.

The California Horse Racing Board entered into a stipulated agreement with trainer Doug O'Neill, who agreed to pay a fine of $7,500 and to serve a 30-day suspension, which shall be stayed pending a one-year probation, for violation of CHRB Rules 1843, 1843.1, 1843.6, and 1887 after the Maddy Laboratory reported that a sample taken from a horse in his care, Chicks Rule, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Chicks Rule finished first in the third race at Santa Anita Park on January 17, 2008. The stewards at Santa Anita previously issued a ruling disqualifying Chicks Rule and redistributing the purse. The 30-day suspension is stayed provided O'Neill has no additional Class 1, 2, or 3 violations for one year.

September 25

The CHRB has adopted the proposed decision of Administrative Law Judge Daniel Juarez, who conducted a hearing July 15, 2008, on the status of the California license for jockey Patrick Valenzuela. As ordered by Judge Juarez and adopted by the Board in executive session on September 18: "1. Respondent Patrick Valenzuela's conditional license is revoked. 2. Respondent Patrick Valenzuela is permanently ineligible to reapply for, or to hold, a license issued by the California Horse Racing Board."

The stewards at Los Alamitos fined trainer Jose De La Torre $20,000 and suspended him for 180 days beginning September 25 for violation of CHRB Rules 1843 (a) (c) (d), 1844 (e) (f), and 1887 after the Maddy Laboratory reported that blood and urine samples taken from two horses in his care, Classic Colt and A Fortunate Son, exceeded the regulatory threshold for clenbuterol (Class 3), Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. Classic Colt finished second in the ninth race at Los Alamitos on June 14, 2008. A Fortunate Son finished fifth in the eighth race at Los Alamitos on June 28, 2008. The stewards also disqualified both horses and ordered the redistribution of those purses.

The California Horse Racing Board has filed a complaint against trainer Steven Miyadi for violation of CHRB Rules 1843 (a) (d), 1843.1 (b), 1844 (e) (10), 1887, and 1894 after the Maddy Laboratory at UC Davis reported the urine sample taken from Anziyan's Song, a horse in his care, exceeded the regulatory limit for 16-beta-hydroxystanozolol, a metabolite of the anabolic steroid stanozolol. Stanozolol is a synthetic anabolic steroid sold under the brand name Winstrol. Anziyan's Song finished first in the fifth race at Cal Expo (State Fair meet) on August 29, 2008. The stewards at Golden Gate Fields have scheduled a hearing for October 12. As this alleged violation occurred prior to September 4, it is a Class 4 violation subject to Category D penalties. A Category D penalty is an official warning that goes on the trainer's permanent official record. As of September 4, stanozolol, nandrolone, boldenone, and testosterone have been moved to Class 3 drugs and to Category B penalties. The presence of these anabolic steroids above regulatory thresholds in post-race samples collected on or after September 4 will result in the automatic disqualification of the horse and redistribution of the purse. Category B penalties call for a minimum 30-day suspension and a fine up to $10,000.

September 21

The California Horse Racing Board has filed four complaints against trainer John Sadler after the Maddy Laboratory at UC Davis reported that urine samples taken from four horses in his care exceeded the regulatory limits for 16-beta-hydroxystanozolol, a metabolite of the anabolic steroid stanozolol. Stanozolol is a synthetic anabolic steroid sold under the brand name Winstrol. The findings were confirmed by Iowa State University Racing Chemistry Laboratory. As these alleged violations occurred prior to September 4, they were Class 4 violations subject to Category D penalties. A Category D penalty is an official warning that goes on the trainer's permanent official record.

As of September 4, stanozolol, nandrolone, boldenone, and testosterone have been moved to Class 3 drugs and to Category B penalties. The presence of these anabolic steroids above regulatory thresholds in post-race samples collected on or after September 4 will result in the automatic disqualification of the horse and redistribution of the purse. Category B penalties call for a minimum 30-day suspension and a fine up to $10,000.

The four Class 4 complaints against Sadler involve the horses:

·        Soupy, which finished first in the third race at Del Mar on August 1, 2008;

·        Tizsweetdreams, which finished third in the fourth race at Del Mar on August 1, 2008;

·        Chanjo, which finished first in the tenth race at Del Mar on August 2, 2008; and

·        Sunshine Ridge, which finished first in the fifth race at Del Mar on August 3, 2008;

The stewards at Santa Anita Park have scheduled an October 2 hearing on all four complaints.
 

September 14

The CHRB filed a complaint against trainer Mike Mitchell for violation of CHRB Rules 1843 (a) (d), 1844 (e), and 1887 after the Maddy Laboratory at the University of California, Davis, reported that a sample taken from a horse in his care, Scat Thief, exceeded the regulatory threshold for procaine. The CHRB filed a complaint against trainer Sean McLaughlin for violation of CHRB Rules 1843 (a) (b) (d), 1843.2, 1859.5, and 1887 after the Ken Maddy Laboratory at UC Davis determined the urine sample collected from a horse in his care, Dab of Lightning, contained 3-hydroxy lidocaine. Industrial Laboratory confirmed the presence of 3-hydroxy lidocaine in the split sample. 3-hydroxy lidocaine is the major urinary metabolite of lidocaine, a local anesthetic. This is a Class 2 violation. Dab of Lightning finished first in the ninth race at the Solano County Fair on July 20, 2008. The stewards have scheduled a hearing October 31, 2008, at Golden Gate Fields.
 

September 7

The California Horse Racing Board has filed five complaints against trainer Steven Miyadi for violation of CHRB Rules 1843 (a) (d), 1843.1 (b), 1844 (e) (10), 1887, and 1894 after the Maddy Laboratory at UC Davis reported that urine samples taken from five horses in his care exceeded the regulatory limits for 16-beta-hydroxystanozolol, a metabolite of the anabolic steroid stanozolol. Stanozolol is a synthetic anabolic steroid sold under the brand name Winstrol. Miyadi and the owners of these horses did not request split sample confirmations. As these alleged violations occurred prior to September 4, they were Class 4 violations subject to Category D penalties. A Category D penalty is an official warning that goes on the trainer's permanent official record.

As of September 4, stanozolol, nandrolone, boldenone, and testosterone have been moved to Class 3 drugs and to Category B penalties. The presence of these anabolic steroids above regulatory thresholds in post-race samples collected on or after September 4 will result in the automatic disqualification of the horse and redistribution of the purse. Category B penalties call for a minimum 30-day suspension and a fine up to $10,000.

The five Class 4 complaints against Miyadi involve the horses:

--My Cee Vee, which finished second in the sixth race at the Sonoma County Fair on August 1, 2008;
--Beau Geni, which finished first in the ninth race at the San Mateo County Fair (SMCF) on August 6, 2008;
--Tuscan Fever, which finished first in the seventh race at SMCF on August 9, 2008;
--Pull Away, which finished first in the first race at SMCF on August 10, 2008; and
--Run Savio Run, which finished first in the seventh race at SMCF on August 16, 2008.

The stewards at Golden Gate Fields have scheduled a September 28 hearing on all five complaints. 

Pursuant to a stipulated agreement between the California Horse Racing Board and trainer Frank Petrelli, the stewards at Cal Expo issued a $3,000 fine and suspended Petrelli for 30 days for violation of CHRB Rules 1843 (a) (c) (d), 1887, and 1890 after the Maddy Laboratory at UC Davis identified detomidine in the urine sample collected from Only In California, a horse in his care. Detomidine is an alpha-2 adrenergic agonist used as a sedative/tranquilizer/analgesic for horses. Detomidine is sold under the brand name Domosedan. At the time of this violation, detomidine was a Class 2 violation. Investigators also found contraband consisting of 10 bottles of unlabeled drugs and one syringe and needle during a search of Petrelli's barn. Only In California finished first in the sixth race at Cal Expo on November 15, 2007. The stewards disqualified Only In California and ordered a redistribution of the purse. Petrelli began serving the 30-day suspension on September 1.

August 30

The stewards at Del Mar disqualified Zanda Blue and ordered the redistribution of the purse for the first race at Hollywood Park on July 2, 2008, in which Zanda Blue finished first, after the Maddy Laboratory at the University of California, Davis, reported that a sample taken from Zanda Blue exceeded the regulatory threshold for procaine. The finding was confirmed by Iowa State University Racing Chemistry Laboratory. Procaine is a local anesthetic and is found in procaine penicillin G, a commonly administered antibiotic. For this reason procaine is a Class 3 violation rather than a Class 2 violation, as are other local anesthetics. A hearing is pending for Thomas Bell II, the trainer of Zanda Blue, 

The California Horse Racing Board entered into a stipulated agreement with trainer Darrell Vienna, who agreed to pay a fine of $8,500 for violation of CHRB Rules 1843 (a) (d), 1844 (e), and 1887 after the Maddy Laboratory at UC Davis identified clenbuterol in excess of the authorized decision level in urine samples collected from Medici Code following two consecutive races. Industrial Laboratories confirmed the presence of clenbuterol above the authorized decision level in both split samples. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. These are Class 3 violations. Medici Code finished second in the fourth race at Del Mar on July 18, 2007, and then finished first in the ninth race at Del Mar on August 11, 2007. The stewards at Santa Anita Park issued rulings last November disqualifying Medici Code from those races and redistributing the purses.

August 24

The CHRB filed a complaint against trainer Thomas Bell II for violation of CHRB Rules 1843 (a) (d), 1844 (e) (7), and 1887 after the Maddy Laboratory at the University of California, Davis, reported that a sample taken from a horse in his care, Zanda Blue, exceeded the regulatory threshold for procaine. The finding was confirmed by Iowa State University Racing Chemistry Laboratory. Procaine is a local anesthetic and is found in procaine penicillin G, a commonly administered antibiotic. For this reason procaine is a Class 3 violation rather than a Class 2 violation, as are most other anesthetics. Zanda Blue finished first in the first race at Hollywood Park on July 2, 2008. The stewards at Del Mar have scheduled a hearing on August 27.

The CHRB filed a complaint against trainer Adan Farias for violation of CHRB Rules 1843 (a) (b) (d), 1844 (e) (f), and 1887 after the Maddy Laboratory at the University of California, Davis, reported the blood and urine samples taken from Wild Choice, a horse in his care, exceeded the regulatory threshold for clenbuterol. Farias declined a split sample analysis. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Wild Choice finished first in the fourth race at Los Alamitos on July 11, 2008. A hearing will be scheduled after Farias completes a 30-day suspension that he currently is serving for his last clenbuterol violation. This complaint will be his third clenbuterol violation in 2008.

August 15

The CHRB filed a complaint against trainer Jeff Mullins for violation of CHRB Rules 1843 (a), 1843.6 (d) (1) (2), and 1887 after the Maddy Laboratory at UC Davis reported the blood sample taken from Pathbreaking, a horse in his care, exceeded the regulatory threshold of 37.0mm1/1 for total carbon dioxide (TCO2), This is a Class 3 violation. Pathbreaking finished third in the third race at Del Mar on August 3. The stewards have scheduled a hearing for August 20 on the disqualification of Pathbreaking. A hearing for Mullins has not been scheduled.

The stewards at Los Alamitos suspended trainer Adan Farias 30 days and issued a $5,000 fine for violation of CHRB Rules 1843 (a) (b) (d), 1844 (f) and 1887 after the Maddy Laboratory at UC Davis reported that the blood sample taken from Fighter on Fire, a horse in his care, exceeded the regulatory threshold for clenbuterol.  Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Fighter on Fire ran first in the ninth race at Los Alamitos on April 11, 2008. The suspension will run August 16 through September 14. The stewards also disqualified Fighter on Fire and ordered a redistribution of the purse.

The CHRB filed two complaints against trainer Jose De La Torre for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f) and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from two horses in his care, Classic Colt and A Fortunate Son, exceeded the regulatory threshold for clenbuterol (Class 3), Classic Colt finished second in the ninth race at Los Alamitos on June 14, 2008. A Fortunate Son finished fifth in the eighth race at Los Alamitos on June 28, 2008. A hearing is scheduled September 12..

August 1

In accordance with a stipulated agreement between the CHRB and trainer Christopher Beau Greely, the stewards at Del Mar suspended Greely for 30 days and issued a $3,000 fine for violation of CHRB Rules 1843 (a) and 1887after the Ken Maddy Laboratory at UC Davis identified hydroxy-carisoprodol and meprobomate in the post-race sample of a horse in his care, Rather Be Lucky. Carisoprodol is a centrally acting skeletal muscle relaxant. Meprobomate is a pharmacologically active metabolite of carisoprodol with anxiolytic and sedative properties. At the time of the violation, Carisoprodol was a Class VI violation in California; meprobomate is a Class 2 violation. Pursuant to the terms of the stipulated agreement, the stewards stayed the 30-day suspension, provided Greely has no further Class 1, 2, or 3 violations during the term of his one-year probation. Rather Be Lucky finished first in the third race at Santa Anita on January 21, 2008. In a separate ruling, the stewards previously disqualified Rather Be Lucky and ordered a redistribution of the purse.

The stewards at Del Mar issued two disqualifications after the Ken Maddy Laboratory at UC Davis determined that urine samples collected from the horses Peace Pledge and Dunmore contained guanabenz. Guanabenz is an alpha-2 adrenergic agonist used to treat hypertension in people. This family of drugs also produces tranquilizer/sedative/analgesic effects in horses and includes the FDA approved equine drugs xylazine and detomidine. These were Class 2 violations. Peace Pledge finished third in the sixth race at Del Mar on July 18, 2007. Dunmore finished fifth in the second race at Del Mar on July 22, 2007. The stewards ordered the redistribution of both purses. In a separate ruling, the stewards previously suspended and fined Cody Autrey, the trainer of Peace Pledge and Dunmore.

July 26

The stewards at Los Alamitos suspended owner/assistant trainer Ugo De La Torre for 30 days for violation of CHRB Rules 1489, 1843 (c), and 1890 after CHRB investigators recovered needles, syringes, and injectable medications during a search of his person and vehicle at Los Alamitos Race Course. During the term of his suspension (July 26 through August 24), De La Torre is denied access to all premises in the CHRB's jurisdiction, and he is on probation for the term of his license.

July 12

In accordance with a stipulated agreement between the CHRB and trainer Cody Autrey, the stewards at Hollywood Park suspended Autrey for 30 days and issued a $12,500 fine for violation of CHRB Rules 1843, 1843.2, and 1887, after the Ken Maddy Laboratory at UC Davis determined that urine samples collected from two horses in his care, Peace Pledge and Dunmore, contained guanabenz. Guanabenz is an alpha-2 adrenergic agonist used to treat hypertension in people. This family of drugs also produces tranquilizer/sedative/analgesic effects in horses and includes the FDA approved equine drugs xylazine and detomidine. These are Class 2 violations. Peace Pledge finished third in the sixth race at Del Mar on July 18, 2007. Dunmore finished fifth in the second race at Del Mar on July 22, 2007. Pursuant to the stipulated agreement, the stewards stayed 23 days of the suspension for a period of one year, provided that Autrey has no further Class 1, 2, or 3 violations during the term of probation. He began serving the rest of his suspension July 7.

The CHRB filed a complaint against Ugo De La Torre, a licensed owner and assistant trainer, for violation of CHRB Rules 1843 (c), 1890, and 1891 after CHRB investigators recovered needles, syringes, and injectable medications during a search of his person and vehicle at Los Alamitos Race Course. A hearing is scheduled July 17.

The CHRB filed a complaint against Edwin Jeffery Waltenburgh, a licensed owner, trainer, and driver, for violation of CHRB Rules 1489 (h), 1843 (c), 1867 (c), 1890, 1900, and 1902 (b) CHRB investigators and the California State Fair Police (CSFP) recovered syringes, medications, and controlled substances in his trailer at Cal Expo. Waltenburgh was arrested and booked into the Sacramento County jail by CSFP. A court case is pending. An administrative hearing is scheduled July 25.

The stewards at Hollywood Park disqualified Rather Be Lucky and ordered a redistribution of the purse for the third race at Santa Anita on January 21, 2008, after the Maddy Laboratory at UC Davis identified hydroxy-carisoprodol and meprobomate in the post-race sample. Rather Be Lucky finished first in the race. Carisoprodol is a centrally acting skeletal muscle relaxant. Meprobomate is a pharmacologically active metabolite of carisoprodol with anxiolytic and sedative properties. Carisoprodol is currently a Class VI violation in California; meprobomate is a Class 2 violation. A case is pending against Beau Greely, the trainer of Rather Be Lucky.

June 21

The stewards at Golden Gate Fields issued a $4,000 fine to trainer Cirilo Sierra for violation of CHRB Rules 1843 (a) (d) and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from Indian Weaver, a horse in his care, exceeded the regulatory threshold for clenbuterol. The finding was confirmed by Iowa State University laboratory. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Indian Weaver ran second in the first race at Bay Meadows on April 11, 2008. The stewards disqualified Indian Weaver and ordered the redistribution of the purse.

June 7

The stewards at Los Alamitos fined trainer Adan Farias $5,000 for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f), and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from a horse in his care, Mia Fancy Fame, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Mia Fancy Fame finished first in the ninth race at Los Alamitos on February 17, 2008. The stewards also issued a $2,500 fine to Jesus Avila, the owner of Mia Fancy Fame, who admitted to administering clenbuterol to the horse at the ranch. The stewards ordered a redistribution of the purse.

The stewards at Los Alamitos fined trainer Danny Montes $2,500 for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f), and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from a horse in his care, Shablazin, exceeded the regulatory threshold for clenbuterol. Shablazin finished first in the eighth race at Los Alamitos on March 28, 2008. The stewards ordered a redistribution of the purse.

The stewards at Los Alamitos fined trainer Hector Sanchez $2,500 for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f), and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from a horse in his care, Red Sovine, exceeded the regulatory threshold for clenbuterol. Red Sovine finished first in the fifth race at Los Alamitos on April 3, 2008. The stewards ordered a redistribution of the purse.
 

May 31

The CHRB filed a complaint against trainer Cirilo Sierra for violation of CHRB Rules 1843 (a) (d), 1844 (e), 1859.5, and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from Indian Weaver, a horse in his care, exceeded the regulatory threshold for clenbuterol. The finding was confirmed by Iowa State University laboratory. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Indian Weaver ran second in the first race at Bay Meadows on April 11, 2008. A hearing is scheduled for June 13.

The CHRB filed a complaint against trainer Adan Farias for violation of CHRB Rules 1843 (a) (b) (d), 1844 (f) and 1887 after the Maddy Laboratory at UC Davis reported that the blood sample taken from Fighter on Fire, a horse in his care, exceeded the regulatory threshold for clenbuterol.  Fighter on Fire ran first in the ninth race at Los Alamitos on April 11, 2008. A hearing is scheduled for June 7.
 

May 24

In a form of protest, the board declined to accept and act on the proposed decision of Administrative Law Judge David L. Benjamin in regards to a complaint against trainer Cristopher Vienna. Therefore, under Government Code Section 11517 (c) (2), the proposed decision went into effect May 24 - 100 days after it was received by the CHRB (February 14, 2008).

Judge Benjamin, who conducted a three-day hearing last December, fined Vienna $1,000 and ordered the disqualification of Speak the Language from her first-place finish in the sixth race at Bay Meadows on March 31, 2005. The Ken Maddy Laboratory at UC Davis reported that samples taken from Speak the Language tested positive for fluphenazine.

In his ruling, Judge Benjamin noted the CHRB recommendation for a "30-day suspension and $5,000 fine," but the judge wrote, "In light of the evidence in mitigation, suspension of (Vienna's) license is not warranted. There is no basis, however, to dismiss the proceeding without the imposition of discipline, as (Vienna) requests. Using a Class 2 prohibited drug substance for treatment and then racing the horse shortly thereafter is a high-risk course of action that should be discouraged. A fine of $1,000 will be imposed."

Under law that applied to cases before January 1, 2008, on an accusation matter such as Vienna's that went directly to the Office of Administrative Hearings, the Board could "neither modify nor amend a proposed decision by the administrative law judge so as to increase any sanction or penalty contemplated in the proposed decision." In other words, the board could not, despite strong objection to a proposed decision, take any action that would increase the penalty. (This language has been amended out of the statute, so does not apply to cases since January 1, 2008.) In deciding not to act, the board did not in any sense approve of the level of discipline set forth in the proposed decision.

The stewards at Los Alamitos fined trainer Jose De La Torre $15,000  for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f), and 1887, after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from six horses in his care exceeded the regulatory threshold for clenbuterol. The findings were confirmed by Iowa State University laboratory. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation.

The six horses were: LDS Heza Streaker, which finished first in the fourth race on February 16;  Bonos Key, which finished first in the sixth race on February 23; Bonos Wicked Wench, which finished second in the second race on March 1; Preppy Pilot, which finished first in the first race on March 2; Ima Strawfly, which finished second in the seventh race on March 6, and Call Me a Bono, which finished first in the fourth race on March 8. The stewards disqualified all six horses and ordered redistributions of all the purses.

The stewards at Cal Expo suspended owner Juan Pablo Ramirez for 180 days for violation of CHRB Rule 1890 for possession of contraband, which included multiple syringes, needles, and vials of therapeutic medications, while on the premises of Cal Expo. May 11

The stewards at Los Alamitos issued a $3,000 fine to trainer John Frousiakis for violation of CHRB Rules 1843 (a) (d), 1844 (b) (e) (f), and 1887 after the Maddy Laboratory at UC Davis reported that blood and urine samples taken from a horse in his care, Purple Slurple, exceeded the regulatory threshold for clenbuterol, and the post-race urine sample showed the presence of dexamethasone. The findings were confirmed by Iowa State University laboratory. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses and is a Class 3 violation. Dexamethasone is a commonly used corticosteroid and is a Class 6 violation. Purple Slurple finished first in the second race at Los Alamitos on January 12, 2008. The stewards also disqualified Purple Slurple and ordered a redistribution of the purse.
 

March 28

The stewards at Santa Anita issued a ruling disqualifying Chicks Rule and redistributing the purse for the third race at Santa Anita on January 17, 2008, after the Ken Maddy Laboratory at UC Davis reported that a sample taken from Chicks Rule exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Chicks Rule finished first in the race. A complaint is pending against Doug O'Neill, the trainer of Chicks Rule.

The stewards at Bay Meadows issued a $3,000 fine to trainer Albert Michael Lenzini, the trainer of Lady Woodman, for violation of CHRB Rules 1843 (b) (d), 1843.6 (d), and 1887 after the Maddy Laboratory reported that a sample taken from Lady Woodman exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Lady Woodman finished fifth in the third race at Golden Gate Fields on September 17, 2006. The stewards also disqualified Lady Woodman and ordered a redistribution of the purse.
 

March 21

The stewards at Bay Meadows ruled that license privileges will be restored to suspended owner/trainer/jockey/exercise rider Ingrid Mason upon payment of a $4,000 fine. She was suspended on March 30, 2006, for failure to appear before the stewards in connection with a 2001 violation involving the horse Shawo Mountain relative to a positive for the drug meprobamate. Meprobamate is a sedative once commonly used in humans but is also a pharmacologically active metabolite of the muscle relaxant carosiprodol. Mason acknowledged administering carosiprodol to Shawo Mountain. Meprobamate is a Class 2 violation. Shawo Mountain finished first in the fifth race at Golden Gate Fields on January 28, 2001.

February 15

The stewards at Santa Anita Park issued a ruling disqualifying Rob's Coin from a second-place finish in the 7th race at Hollywood Park on July 8, 2006, and ordered a redistribution of the purse after a post-race urine sample analyzed at the Maddy Laboratory at UC Davis was found to contain mepivacaine in excess of the regulatory threshold level. Industrial Laboratories, the split sample laboratory selected by Jeff Mullins, the trainer of Rob's Coin, confirmed the finding. Mepivacaine is a commonly used local anesthetic in equine veterinary procedures and is a Class 2 violation. Previously, the CHRB adopted the proposed decision of Administrative Law Judge David Rosenman to suspend Mullins for 90 days for violation of CHRB Rules 1843(a), 1843(d), and 1887(a). After serving 20 days, the balance of the suspension shall be stayed, provided that Mullins obeys all horse racing laws and CHRB regulations during the one-year probationary period. Mullins' suspension begins Monday, February 18. 

February 2

The CHRB filed a complaint against trainer Doug O'Neill for violation of CHRB Rules 1843 (a), 1843.6 (d) (1) (2), and 1887 after the Ken Maddy Laboratory at UC Davis reported that a sample taken from a horse in his care, Chicks Rule, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Chicks Rule finished first in the third race at Santa Anita Park on January 17, 2008. A hearing has not been scheduled.

The CHRB filed a complaint against trainer David LaCroix for violation of CHRB Rules 1843 (a) (d), 1844 (e) (9) (F), and 1887 after the Maddy Laboratory reported that blood and urine samples taken from a horse in his care, Happyhour Atthebrig, exceeded the regulatory threshold for clenbuterol. LaCroix did not request split sample analysis. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. Happyhour Atthebrig finished second in the fourth race at Hollywood Park on December 1, 2007. The stewards at Santa Anita have scheduled a hearing on February 17.

The CHRB filed a complaint against trainer Melody Conlon for violation of CHRB Rules 1843 (a) (d), 1844 (e) (9) (F), and 1887 after the Maddy Laboratory reported that blood and urine samples taken from a horse in her care, Tommys Luck, exceeded the regulatory threshold for clenbuterol. This is a Class 3 violation. The University of Florida Laboratory confirmed the excess level of clenbuterol in the split samples. Tommys Luck finished first in the sixth race at Hollywood Park on November 21, 2007. The stewards at Santa Anita have scheduled a hearing on February 16.

The CHRB filed a complaint against trainer Patty Lou Harris for violation of CHRB Rules 1843 (a) (d) and 1887 after the Maddy Laboratory reported that a sample collected from a horse in her care, Biggest Big Bertha, tested positive for 4-hydroxypropranolol. The University of Pennsylvania Laboratory confirmed the presence of 4-hydroxypropranolol in the split sample. 4-hydroxypropranolol is a metabolite of propranolol. Propranolol is a beta-2 adrenergic blocking agent occasionally used in humans for hypertension. This is a Class 3 violation. Biggest Big Bertha finished first in the seventh race at Cal Expo on November 3, 2007. A hearing has not been scheduled.

Sacramento Superior Court Judge Matthew Gary sentenced former Cal Expo harness driver Daniel Maier to one year in county jail and five years formal probation following Maier's felony conviction for race fixing, as reported in a CHRB news release dated December 21, 2007, which is available on the CHRB website (www.chrb.ca.gov). During probation, Maier must stay away from all gambling facilities. Previously, the stewards at Cal Expo suspended Maier for the term of his current license (through April 30, 2008) for violation of Rules 1489 (a) (f) (g) (j), 1530, 1902 (b) (c), and 1980 (a) (3) (b) (4). The stewards further ordered and recommended that any future applications for license by Maier be denied.

January 25

The California Horse Racing Board has adopted the proposed decision of Administrative Law Judge David Rosenman to suspend trainer Jeff Mullins for 90 days for violation of CHRB Rules 1843(a), 1843(d), and 1887(a). After serving 20 days, the balance of the suspension shall be stayed, provided that Mullins obeys all horse racing laws and CHRB regulations during the one-year probationary period. Mullins was the trainer of Rob's Coin when the gelding finished second in the 7th race at Hollywood Park on July 8, 2006. A post-race urine sample analyzed at the Maddy Laboratory at UC Davis was found to contain mepivacaine in excess of the regulatory threshold level. The finding was confirmed by Industrial Laboratories, the split sample laboratory chosen by Mullins. Mepivacaine is a commonly used local anesthetic in equine veterinary procedures and is a Class II violation.

January 5

In accordance with a stipulated agreement between the California Horse Racing Board and trainer Michael Pender, the stewards at Santa Anita Park suspended Pender for 30 days and issued a $7,500 fine for violation of CHRB Rules 1843.2, 1844 (a) (b) (d), and 1887 after a horse in his care, Queen of the Derby, tested positive for guanabenz. Guanabenz is an alpha-2 adrenergic agonist used to treat hypertension in people. This family of drugs also produces tranquilizer/sedative/analgesic effects in horses and includes the FDA approved equine drugs xylazine and detomidine. This is a Class 2 violation. Queen of the Derby finished first in the eighth race at Del Mar on July 25, 2007. Under the terms of the agreement, 15 days of the suspension were stayed, provided Pender has no additional Class 1, 2, or 3 violations during the term of his one-year probation.

December 28

The CHRB filed a complaint against trainer Frank Petrelli for violation of CHRB Rules 1843 (a) (b) (d) and 1887 after the Maddy Laboratory at the University of California, Davis, reported that a post-race sample taken from Only in California, a horse trained by Petrelli, contained the prohibited substance hydroxydetomidine. Truesdail Laboratories confirmed the presence of hydroxydetomidine in the split sample. Hydroxydetomidine is a major metabolite of detomidine, an alpha 2-adrenergic agonist used as a sedative/analgesic in the equine under the brand name Domosedan. This is a Class 2 violation in California. Only in California ran first in the sixth race at Cal Expo on November 15, 2007. A hearing has not been scheduled.

The CHRB filed a complaint against Daniel Ray Maier for violation of CHRB Rules 1489 (a) (f) (g) (j), 1530, 1900, 1902 (b) (c), and 1980 (a) (3) and (b) (4) after a Sacramento County Superior Court found him guilty of conspiracy, grand theft, and offering a bribe to effect the outcome of a race, all felonies. Pursuant to Business and Professions Code Sections 19420 and 19440 and CHRB rules, the stewards are empowered to impose penalties for any violation of any provision of the CHRB rules. Such penalties may consist of suspension of any license, fines, and exclusion from all racing enclosure under the jurisdiction of the Board. Maier is a licensed harness driver. The stewards at Cal Expo have scheduled a hearing for January 11, 2008.

December 16

The stewards at Golden Gate Fields issued a 30-day suspension to Dr. Kim Kuhlmann for negligence in regards to the identification of the Class 2 prohibited substance 3-hydroxy lidocaine, the major urinary metabolite of lidocaine, a local anesthetic present in the post-race urine sample of El Sierra Tahoe. Dr. Kuhlmann had reported treating El Sierra Tahoe with the approved bleeder medication furosemide, but no furosemide was present in the post-race sample. Dr. Kuhlmann had previously sutured a wound on another patient using lidocaine as the local anesthetic and accepted responsibility for the medication error. The stewards found the veterinarian in violation of CHRB Rules 1843 (a) (b) (d), 1843,5 (c), 1845 (e), and 1887. Dr. Kuhlmann requested a stay of his penalty pending an appeal. The stay has been granted.

Jeff Bonde was the trainer of El Sierra Tahoe, which finished first in the ninth race at Bay Meadows on September 1, 2007. At the request of the CHRB, the complaint against Bonde in relation to the 1843 violations for 3-hydroxy lidocaine in the post-race urine sample of El Sierra Tahoe was dismissed. The stewards disqualified El Sierra Tahoe and ordered a redistribution of the purse. In a related case, the stewards fined Bonde $1,000 for violation of CHRB Rule 1890 (possession of contraband).

The stewards at Golden Gate Fields fined trainer Gregory Gilchrist $1,500 for violation of CHRB Rules 1843 (a) (d), 1844 (e), 1859.5, and 1887 after a sample collected from a horse in his care, Yodelay You're Who, exceeded the regulatory threshold for procaine. Procaine is a local anesthetic also found in procaine penicillin G antibiotic preparations. Veterinary records showed another horse in the stable was under treatment with procaine penicillin G antibiotics. This is a Class 3 violation. Yodelay You're Who finished first in the second race at Bay Meadows on September 26, 2007. The stewards also disqualified Yodelay You're Who and ordered a redistribution of the purse.

December 6

In accordance with a stipulated agreement between the CHRB and trainer Vladimir Cerin, the stewards at Hollywood Park fined the trainer $7,500 and issued a 15-day suspension for violation of CHRB Rules 1843 (a) (d) and 1887 after two horses in his care, North Fleet Street and Off the Richter, tested positive for norpseudoephredrine and phenylpropanolamine, both Class 3 violations. Norpseudoephredrine and phenylpropanolamine can be found in urine samples after the ingestion of herbal products containing ephedra and in several over-the-counter products for both horse and human respiratory conditions. Under the terms of the agreement, the stewards stayed the suspension provided Cerin has no further Class 1, 2, or 3 violations during a probationary period through August 31, 2008. Off the Richter finished third in the fifth race at Fairplex Park on September 10, 2006. The stewards disqualified Off the Richter and ordered a redistribution of the purse. North Fleet Street finished first in the 12th race at Fairplex on September 25, 2006.  North Fleet Street was disqualified and the purse redistributed in an earlier ruling.

The California Horse Racing Board, meeting in executive session November 29, adopted a stipulated proposed settlement agreement and mutual release with Kathleen A. Plested suspending the trainer for one year for violation of CHRB Rules 1843 (a, d), 1887, and 1859.5 after the Maddy Laboratory at the University of California, Davis, identified the presence of methamphetamine and amphetamine in the urine sample collected from Casimir Dow Jones, a horse in her care. Methamphetamine is a psychostimulant drug commonly referred to as "meth," a human drug of abuse. Methamphetamine is closely related to amphetamine. Methamphetamine is believed to enter the horse from incidental contact with humans.  This is a Class 1 violation. Under the agreement, the final six months of the suspension will be stayed provided she has no further Class 1, 2, or 3 violations during a probationary period of one year. Casimir Dow Jones finished first in the ninth race at Cal Expo on January 20, 2007. 

November 25

The stewards at Golden Gate Fields issued a $3,000 fine to trainer Gary Stute for violation of CHRB Rules 1843 (a)(d), 1843.6 (d) (1) (2), and 1887 after a horse in his care, Theory, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Theory finished third in the sixth race at Bay Meadows on February 28, 2007. In a previous ruling, the stewards disqualified the horse and ordered redistribution of the purse.

The stewards at Cal Expo issued a $3,000 fine to trainer Tom Wine II for violation of CHRB Rules 1843.6 (d) (1) (2) and 1887 after a horse in his care, Mac Jonathan VP, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Mac Jonathan VP finished first in the sixth race at Cal Expo on October 6, 2007. The stewards disqualified Mac Jonathan VP and ordered redistribution of the purse.
 

November 10

The CHRB filed a complaint against trainer Gregory Gilchrist for violation of CHRB Rules 1843 (a) (d), 1844 (e), 1859.5, and 1887 after the Ken Maddy Laboratory at UC Davis determined a sample collected from a horse in his care, Yodelay You're Who, exceeded the regulatory threshold for procaine. Industrial Laboratories confirmed the finding of procaine in the duplicate sample above the authorized level. Procaine is a local anesthetic but is also found in procaine penicillin G antibiotic preparations. This is a Class 3 violation. Yodelay You're Who finished first in the second race at Bay Meadows on September 26, 2007. A hearing is scheduled December 14, 2007.

November 4

The Santa Anita stewards issued two rulings disqualifying Medici Code and redistributing the purses from races run at Del Mar after the Ken Maddy Laboratory at UC Davis identified clenbuterol in excess of the authorized decision level in urine samples collected from Medici Code. Industrial Laboratories confirmed both samples. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. These are Class 3 violations. Medici Code finished second in the fourth race at Del Mar on July 18, 2007, and then finished first in the ninth race at Del Mar on August 11, 2007. Complaints are pending against Darrell Vienna, the trainer of Medici Code.

October 25

In accordance with a stipulated agreement between the CHRB and trainer Sean McLaughlin, the stewards at Bay Meadows suspended McLaughlin for 15 days and issued a $7,500 fine for violation of CHRB Rules 1843 (a) (d), 1843.6 (d) (1) (2), and 1887 after a horse in his care, Feel the Music, tested positive for albuterol, and another horse in his care, No Derby, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). Albuterol is a bronchodilator. These are Class 3 violations. Under the terms of the stipulated agreement, the stewards stayed the $7,500 fine provided McLaughlin has no other Class 1, 2, or 3 violations during the term of a one-year probation. His suspension runs from October 18, 2007, through November 1, 2007. Feel the Music finished ninth in the fourth race at Golden Gate Fields on October 6, 2006, and did not earn a portion of the purse. No Derby finished fifth in the fifth race at Golden Gate Fields on January 6, 2007. The stewards disqualified No Derby and ordered a redistribution of the purse pursuant to CHRB Rule 1859.5.

October 20

The CHRB filed a complaint against trainer Gerald Hollendorfer for violation of CHRB Rules 1843 (a) (b) (d), 1859.5, and 1887 after the Ken Maddy Laboratory at UC Davis determined the urine sample collected from a horse in his care, Gold Ruckus, contained 3-hydroxy xylazine. Pennsylvania Equine Toxicology Laboratory confirmed the presence of 3-hydroxy xylazine in the split sample. 3-hydroxy xylazine is the major metabolite of xylazine, and FDA-approved tranquilizer for horses. This is a Class 2 violation. El Gold Ruckus finished second in the first race at Golden Gate Fields on June 2, 2007. A hearing has not been scheduled.

The CHRB filed a complaint against trainer Thomas C. Wine II for violation of CHRB Rules 1843.1 (b), 1843.6 (d) (1) (2), 1859.5, and 1887, after the Ken Maddy Laboratory at UC Davis determined the urine sample collected from a horse in his care, Mac Jonathan VP, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). The trainer did not request testing of the duplicate sample.  This is a Class 3 violation. Mac Jonathan VP finished first in the sixth race at Cal Expo on October 6, 2007. A hearing is scheduled November 1, 2007.

The stewards at Santa Anita disqualified Iron Butterfly from second in the second race at Santa Anita Park on January 7, 2007, and ordered the purse distributed after Iron Butterfly tested positive for salmeterol. This is a Class 3 violation. Salmeterol is a beta-2 agonist similar to clenbuterol and albuterol.
 

October 13

In accordance with a stipulated agreement between the CHRB and Lauren Veon, the stewards at Cal Expo fined the trainer $1,500 and issued a 15-day suspension (stayed) for violation of CHRB Rules 1843, 1843.6 (d), and 1887 after a horse in his care, Roughing the Passer, tested positive for 4-hydroxypropranolol. 4-hydroxypropranolol is a metabolite of propranolol. Propranolol is a beta-2 adrenergic blocking agent occasionally used in humans for hypertension. This is a Class 3 violation. In accordance with the stipulated agreement, Veon is placed on probation for a period of one year with the suspension stayed, provided he has no further Class 1, 2, or 3 medication violations during the term of probation. Roughing the Passer finished first in the second race at Cal Expo on May 30, 2007. Pursuant to the agreement, the stewards disqualified Roughing the Passer and ordered a redistribution of the purse.

September 28

The CHRB filed two complaints against trainer Darrell Vienna for violation of CHRB Rules 1843 (a) (d) and 1887, both complaints involving the same horse, Medici Code. The Ken Maddy Laboratory at UC Davis identified clenbuterol in excess of the authorized decision level in urine samples collected from Medici Code following two different races. Industrial Laboratories confirmed the presence of clenbuterol above the authorized decision level in both split samples. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. These are Class 3 violations. Medici Code finished second in the fourth race at Del Mar on July 18, 2007, and then finished first in the ninth race at Del Mar on August 11, 2007. A hearing date has not been set.

The CHRB filed two complaints against trainer Cody Autrey for violation of CHRB Rules 1843 (a) (b), 1843.2, and 1887, after the Ken Maddy Laboratory at UC Davis determined that urine samples collected from two horses in his care, Peace Pledge and Dunmore, contained guanabenz. Guanabenz is an alpha-2 adrenergic agonist used to treat hypertension in people. This family of drugs also produces tranquilizer/sedative/analgesic effects in horses and includes the FDA approved equine drugs xylazine and detomidine. The Iowa State University laboratory confirmed the split sample from Peace Pledge. The request to test the split from Dunmore was untimely under Rule 1859.25 and has been denied.  These are Class 2 violations. Peace Pledge finished third in the sixth race at Del Mar on July 18, 2007. Dunmore finished fifth in the second race at Del Mar on July 22, 2007. A hearing date has not been set.

September 7

This is the California Horse Racing Board's weekly update of complaints, accusations, stewards rulings, and Board decisions involving Class 1, 2, and 3 medication violations and other significant matters.

In accordance with a stipulated agreement between the California Horse Racing Board and trainer Patrick Biancone, the stewards at Del Mar fined Biancone $10,000 and issued a 15-day suspension (stayed) for violation of CHRB Rules 1843 (a) (b) (c) (d) and 1887 after a horse in his care, Iron Butterfly, tested positive for salmeterol. This is a Class 3 violation. Salmeterol is a beta-2 agonist similar to clenbuterol and albuterol. Iron Butterfly finished second in the second race at Santa Anita Park on January 7, 2007. A hearing is pending on the disqualification of the horse. Pursuant to the stipulated agreement, the stewards stayed the 15-day suspension, provided Biancone has no additional Class 1, 2, or 3 violations for one year. The stewards had previously postponed a hearing on a related complaint against veterinarian Dr. Rod Stewart.

The CHRB filed a complaint against trainer Lauren Edward Veon for violation of Rules 1843 (a) (d) and 1887 after a horse in his care, Roughing the Passer, which finished first in the second race at Cal Expo on May 30, 2007, tested positive for 4-hydroxypropranolol. The Maddy Laboratory at U.C. Davis reported the findings, which were confirmed by Iowa State University Laboratory testing of the split sample. 4-hydroxypropranolol is a metabolite of propranolol. August 24

The stewards at Los Alamitos suspended trainer Antonio Soto for 15 days and issued a $3,000 fine for violation of CHRB Rules 1843 (a) (b) (d), 1844 (e), and 1887 after a horse in his care, Boo Boo Buckaroo, tested positive for albuterol, a Class 3 prohibited substance. Albuterol is a beta-2 agonist bronchodilator commonly used in horses. Boo Boo Buckaroo finished first in the sixth race at Los Alamitos on May 26, 2007. The stewards disqualified Boo Boo Buckaroo and ordered a redistribution of the purse.

The aforementioned albuterol positive violates the probation conditions of a standing stipulated agreement between the CHRB and Antonio Soto pertaining to a Rule 1843.6 (TCO2) violation at the San Mateo County Fair on August 9, 2006. In a separate ruling, the stewards ordered Soto to pay an additional $3,000 fine per the terms of the stipulated agreement.

In accordance with a stipulated agreement between the California Horse Racing Board and trainer Mark Hall, the stewards at the Humboldt County Fair suspended Hall for seven days and issued a $3,000 fine for violation of CHRB Rules 1843.1, 1846 (d) (1) (2), and 1887 after a horse in his care, Smooth Gin, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation.  Under the terms of the agreement, the stewards stayed the $3,000 fine provided Hall has no other Class 1, 2, or 3 violations during the term of a one-year probation. Smooth Gin finished fifth in the seventh race at Golden Gate Fields on January 26, 2007. The stewards disqualified Smooth Gin and ordered a redistribution of the purse.
 

August 9

The stewards at Los Alamitos suspended trainer Blane Schvaneveldt for 45 days beginning August 9 for violation of CHRB Rules 1489 (h) (j), 1843 (a) (c) (d), 1887 (a), 1890, and 1902 after a horse in his care, Offdashn, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. Offdashn finished first in the fourth race at Los Alamitos on November 7, 2003. Originally, the suspension was issued April 13, 2004, but the penalty was stayed pending an appeal. Last month the California Horse Racing Board approved the proposed decision of an administrative law judge to deny the appeal and uphold the suspension.

In accordance with a stipulated agreement between the California Horse Racing Board and Paulo Lobo, the stewards at Del Mar fined the trainer $3,000 for violation of CHRB Rules 1843 (a) (d), 1844 (e), and 1887 after a horse in his care, Right Special, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. Right Special finished first in the third race at Hollywood Park on April 26, 2007. The stewards disqualified Right Special and ordered a redistribution of the purse.

The CHRB filed a complaint against trainer Antonio Soto for violation of CHRB Rules 1843 (a) (b) (d), 1844 (e), and 1887 after the Maddy Laboratory at the University of California, Davis, reported the official urine sample taken from a horse in his care, Boo Boo Buckaroo, contained albuterol, a Class 3 prohibited substance. Albuterol is a beta-2 agonist bronchodilator commonly used in horses. Boo Boo Buckaroo finished first in the sixth race at Los Alamitos on May 26, 2007. A hearing is scheduled August 18. 
 

August 5

Jockey Carlos Bautista began serving a one-year suspension on July 24 after the stewards at Los Alamitos received notification from the Orange County Superior Court that a temporary restraining order had been lifted, allowing them to enforce previous rulings for violations of CHRB Rules 1890 (Possession of Contraband) and 1902.5 (Animal Welfare). The suspension followed a two-day hearing in October on a complaint filed by the CHRB alleging that Bautista used an electrical device to shock a horse, Royal Medallion, during the warm-up period prior to the start of the second race at Fairplex Park on September 24, 2006. There was no allegation that Bautista used an electrical device during the actual running of the race. Royal Medallion finished third.

In accordance with a stipulated agreement between the CHRB and Mike Pender, the stewards at Del Mar fined the trainer $3,000 for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Asian Eyes, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. Asian Eyes finished second in the fifth race at Hollywood Park on May 6, 2007. The stewards disqualified Asian Eyes and ordered a redistribution of the purse.
 

July 14

The stewards at Hollywood Park fined trainer Patrick Biancone $1,500 for violation of CHRB Rule 1845 (a) by failing to designate by time of entry in the Cash Call Mile that Lady of Venice would be treated with Lasix. The filly had run with Lasix in her previous four starts in North America but had not been properly registered for Lasix in a timely manner with the CHRB. The stewards permitted the filly to run with Lasix in the July 6 race consistent with her last four races. Lady of Venice won the Cash Call Mile.

Acting on a report from the Maddy Laboratory at the University of California, Davis, the Board of Stewards at Hollywood Park disqualified Theory from third in the sixth race at Bay Meadows on February 28, 2007, and ordered a redistribution of the purse in accordance with CHRB Rule 1859.5. Theory exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2) in that Bay Meadows race. A hearing is pending for the trainer of record, Gary Stute
 

June 30

The CHRB filed a complaint against trainer Paulo Lobo for violation of CHRB Rules 1843 (d), 1844, and 1887 after a horse in his care, Right Special, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. Right Special finished first in the third race at Hollywood Park on April 26, 2007. A hearing has not been scheduled.

The CHRB filed a complaint against trainer Mike Pender for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Asian Eyes, exceeded the regulatory threshold for clenbuterol, a Class 3 violation. Asian Eyes finished second in the fifth race at Hollywood Park on May 6, 2007. A hearing has not been scheduled.

The proposed decision by Administrative Law Judge Daniel Juarez not to sanction trainer Mike Mitchell in connection with a 2-hydroxyethyl-promazine positive was "deemed adopted" when the Board declined to accept and act on the proposed decision within the required 100 days. Under the ALJ decision, Kool Suggestion was disqualified from second in the seventh race at Oak Tree on October 12, 2005, and the purse redistributed after the horse tested positive for 2-hydroxyethyl-promazine, the predominate metabolite of Acepromazine, a Class 2 violation. Acepromazine is a commonly used tranquilizer in horses. Under the decision, "respondent Mike Mitchell's trainer's license shall not suffer discipline." The Board did not act on the March 15, 2007, proposed decision within 100 days, so under Government Code Section 11517, the proposed decision was "deemed adopted."

Jockey Carlos Bautista obtained a temporary restraining order in Orange County Superior Court staying imposition of a ruling by the stewards at Los Alamitos. In that ruling, the stewards ordered Bautista to serve a one-year suspension from July 5, 2007, through July 4, 2008. This followed an action by the Board to adopt a proposed decision sustaining the October 28, 2006, ruling of the Oak Tree stewards imposing a one-year suspension for possession of contraband under CHRB Rule 1890. The October ruling followed a two-day hearing on a complaint filed by the CHRB alleging Bautista used an electrical device to shock a horse during the warm-up period prior to the start of the second race at Fairplex Park on September 24, 2006. There was no allegation that Bautista used an electrical device during the actual race on the horse, Royal Medallion, which finished third.

The stewards at Hollywood Park disqualified North Fleet Street, the winner of the 12th race at the Los Angeles County Fair on September 25, 2006, under Rule 1859.5, and ordered a redistribution of the purse after the horse tested positive for norpseudoephredrine and phenylpropanolamine, a Class 3 violation. Norpseudoephredrine and phenylpropanolamine can be found in urine samples after the ingestion of herbal products containing ephedra and in several over-the-counter products for both horse and human respiratory conditions. A hearing on the complaint against the trainer of record, Vladimir Cerin, is still pending.
 

June 23

The stewards at Cal Expo suspended trainer Matias Ruiz for 30 days (June 23 - July 22) and issued a $2,500 fine for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Amazing Glide, exceeded the regulatory threshold for albuterol. Amazing Glide finished first in the ninth race at Cal Expo on May 20, 2005. Albuterol is a bronchodilator. This is a Class 3 violation. The trainer has appealed this decision. The stewards disqualified Amazing Glide and ordered a redistribution of the purse. 

In accordance with a stipulated agreement between the CHRB and trainer Gregory Vartanian, the stewards at Hollywood Park suspended Vartanian for 120 days (beginning July 1) and fined him $5,000 for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Youandiatdelmar, tested positive for methamphetamine. This is a Class 1 violation. Methamphetamine is a psychostimulant drug commonly referred to as "meth," a human drug of abuse. Methamphetamine is closely related to amphetamine. Methamphetamine is believed to enter the horse from incidental contact with humans. Youandiatdelmar finished second in the first race at Santa Anita Park on March 30, 2006. Pursuant to the terms of the stipulated agreement, the stewards placed Vartanian on probation for one year and stayed the fine and 30 days of the suspension on condition that he has no Class 1, 2, or 3 violations during probation. The stewards disqualified Youandiatdelmar and ordered a redistribution of the purse.

In accordance with a stipulated agreement between the CHRB and trainer Oscar Garcia, the stewards at Hollywood Park suspended Garcia for seven days (July 6-12) and issued a $3,000 fine for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Super Harmony, tested positive for cetirizine and hydroxyzine. Super Harmony finished second in the first race at Santa Anita Park on January 28, 2007. Hydroxyzine is a medication prescribed for chronic allergies. Cetirizine is a pharmacologically active metabolite of hydroxyzine. This is a Class 3 violation. Pursuant to the terms of the stipulated agreement, the stewards placed Garcia on probation for one year and stayed the fine on condition that he has no Class 1, 2, or 3 violations during probation. The stewards disqualified Super Harmony and ordered a redistribution of the purse.

In accordance with a stipulated agreement between the CHRB and trainer John Sadler, the stewards at Hollywood Park suspended Sadler for 15 days and issued a $7,500 fine for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, Cat and a Half, tested positive for cetirizine and hydroxyzine. The trainer has had previous cetirizine violations. Cat and a Half finished first in the first race at Hollywood Park on November 11, 2006. Pursuant to the terms of the stipulated agreement, the steward placed Sadler on probation for one year and stayed the suspension on condition that he has no Class 1, 2, or 3 violations during probation. The stewards disqualified Cat and a Half and ordered a redistribution of the purse.

The stewards at Los Alamitos issued a $2,000 fine to trainer Adan Farias for violation of CHRB Rules 1843 (a) (d) and 1887 after a horse in his care, How in the Blazes, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. How in the Blazes finished third in the third race at Los Alamitos on April 15, 2007. The stewards disqualified How in the Blazes and ordered a redistribution of the purse.

In accordance with a stipulated agreement between the CHRB and trainer Jorge Alcala, the trainer of Rapid Silver, the stewards at Hollywood Park fined the trainer $3,000 for violation of CHRB Rules 1843.6 and 1887 after Rapid Silver exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Rapid Silver finished first in the eighth race at Santa Anita Park on March 22, 2007. The stewards disqualified Rapid Silver and ordered a redistribution of the purse.

The Board adopted the proposed decision of an administrative law judge approving a stipulated agreement between the CHRB and trainer Doug O'Neill under which the trainer will pay a $3,000 fine for violation of CHRB Rules 1843.6 and 1887 after Wisdom Cat, a horse in his care, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This is a Class 3 violation. Wisdom Cat finished eighth (last) in the seventh race at Hollywood Park on May 27, 2006.

The Board adopted a stipulated agreement with Francisco Martin, Jr.,  the owner and trainer of Bumper Crop, by which the trainer is suspended 180 days and fined $10,000 for violation of CHRB Rules 1887 (a), 1843 (a) (b) and 1902, with the suspension and fine stayed for one year conditioned on one year of operation by Martin as a trainer and/or owner with no new Class 1, 2, or 3 violations, after Bumper Crop tested positive for hydromorphine. Bumper Crop finished second in the seventh race at Solano County Fair on July 21, 2005. Hydromorphine is a semi-synthetic opioid analgesic. This is a Class 1 violation. By agreement, Bumper Crop was disqualified and the purse will be redistributed.
 

June 15

The CHRB filed a complaint against trainer Art Sherman for violation of CHRB Rules 1843 (a) (d), 1843.6 (d) (1,2), 1859.5, and 1887 (a). The Maddy Laboratory at the University of California, Davis, reported that Hatif, a horse trained by Sherman, exceeded the regulatory threshold  of 37.0mm1/1 for total carbon dioxide (TCO2). Hatif ran second in the 10th race at Golden Gate Fields on June 10, 2007. This is a Class 3 violation. A hearing has not been scheduled. Sherman also has a previous violation pending for exceeding the regulatory threshold for TCO2.

The CHRB filed a complaint against trainer Brian Koriner for violation of CHRB Rules 1843 (d), 1844, and 1887 after the Maddy Laboratory at the University of California, Davis, reported that a sample taken from a horse in his care, Black Seventeen, exceeded the regulatory threshold for procaine. A test of the split sample confirmed the laboratory finding. Procaine is a local anesthetic but is also found in procaine penicillin G antibiotic preparations. This is a Class 3 violation. Black Seventeen finished first in the fifth race at Hollywood Park on May 1, 2007. A hearing has not been scheduled.

The CHRB filed a complaint against trainer Adan Farias for violation of CHRB Rules 1843 (a) (d) and 1887 after the Maddy Laboratory at the University of California, Davis, reported that a sample taken from a horse in his care, How in the Blazes, exceeded the regulatory threshold for clenbuterol. Clenbuterol is a beta-2 agonist bronchodilator commonly used in horses. This is a Class 3 violation. How in the Blazes finished third in the third race at Los Alamitos on April 15, 2007. A hearing has been conducted by the Los Alamitos stewards, who have not issued a ruling.

June 8

(Note: The penalty guidelines approved by the Board in April are still under review by the Office of Administrative Law, so they are not yet in effect. These rulings were made independently of those guidelines.)

The stewards at Los Alamitos suspended owner Rafael Sanchez for 30 days (June 1-30) and fined him $2,000 for violation of CHRB Rule 1843 (a) (d) and pursuant to Rule 1900 after the Maddy Laboratory at the University of California, Davis, confirmed the presence of caffeine and caffeine metabolites (theophylline, theobromine, and paraxantine) - Class 2 - and a dipyrone metabolite (4-methylaminoantipryrine) - Class 4 - in the post-race sample of Spanish Tass, a horse he owns. Dipyrone is a non-steroidal anti-inflammatory and spasmolytic drug once commonly used in equine veterinary medicine. Spanish Tass finished first in the second race at Los Alamitos on November 17, 2006. The stewards disqualified Spanish Tass and ordered a redistribution of the purse. The stewards issued a $2,500 fine to Eloy Navarro, the trainer of Spanish Tass, for violation of CHRB Rules 1843 (a) (d) and 1887.
 

May 25

In accordance with a stipulated agreement between the CHRB and Jamey Thomas, the stewards at Golden Gate Fields suspended the trainer 15 days (May 21-June 4), fined him $7,500, and placed him on probation for one year for violation of CHRB Rules 1843.1 (d), 1843.6 (d) (1) (2), and 1887 after two horses in his care, Vilamoura and At A Boy Luther, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). These are Class 3 violations. In accordance with the stipulated agreement, the fine was stayed, provided he has no further Class 1, 2, or 3 medication violations during the term of probation.

Vilamoura finished sixth in the sixth race at Golden Gate Fields on August 26, 2006. At A Boy Luther finished third in the sixth race at Golden Gate Fields on August 27, 2006. The stewards disqualified Vilamoura and At A Boy Luther and ordered a redistribution of the purses.

May 18

The California Horse Racing Board has filed a complaint against trainer Kathleen A. Plested for violation of CHRB Rules 1843 (a, d), 1887, and 1900 after the Maddy Laboratory at the University of California, Davis, identified the presence of methamphetamine and amphetamine in the urine sample collected from Casimir Dow Jones, a horse in her care. The University of Florida Racing Laboratory confirmed the finding in the split sample. This is a Class 1 violation. Casimir Dow Jones finished first in the ninth race at Cal Expo on January 20, 2007. A hearing date has not been set.

The stewards at Hollywood Park issued a ruling disqualifying Starmaniac and redistributing the purse based on a report from Truesdail Laboratories, an official testing laboratory of the CHRB, that the urine sample collected from Starmaniac, who finished first in the sixth race at Hollywood Park on June 10, 2000, contained morphine, a Class 1 violation. The complaint against trainer Robert Frankel had been previously adjudicated.

May 11

The California Horse Racing Board has filed a complaint against trainer Patrick Biancone for violation of CHRB Rules 1843 (a, d) and 1887 after the Maddy Laboratory at the University of California, Davis, identified the presence of salmeterol in the urine sample collected from Iron Butterfly, a horse in his care. The laboratory at Iowa State University confirmed the presence of salmeterol in the split sample. Salmeterol is a beta-2 agonist similar to clenbuterol and albuterol, bronchodilators approved for use in the horse. This is a Class 3 violation. Iron Butterfly finished second in the second race at Santa Anita Park on January 7, 2007. A hearing date has not been set.

April 28

The California Horse Racing Board has filed a complaint against trainer Eloy Navarro for violation of CHRB Rules 1843 (a, d) and 1887 after the Maddy Laboratory at the University of California, Davis, confirmed the presence of caffeine and caffeine metabolites (theophylline, theobromine, and paraxantine) and a dipyrone metabolite (4-methylaminoantipryrine) in the post-race sample of Spanish Tass, a horse in his care. Dipyrone is an anti-pyretic, anti-spasmodic, anti-inflammatory drug once commonly used in equine veterinary care. Spanish Tass finished first in the second race at Los Alamitos on November 17, 2006. A hearing is scheduled for May 5 at Los Alamitos.

April 21

In accordance with a stipulated agreement between the CHRB and owner/trainer Dennis D. Ward, the stewards at Bay Meadows suspended Dennis D. Ward for 60 days for violation of CHRB Rules 1843 (a) (b) (d) and 1887 after Denaesalildevil tested positive for phentermine and its metabolite hydroxyphentermine. Dennis D. Ward was the owner and the assistant trainer in Northern California for the trainer of record, his son, Wesley A. Ward. Phentermine is a stimulant that is similar to amphetamine. Phentermine is used as an appetite suppressant in human medicine. The drug affects the central nervous system and has no legitimate veterinary medical use in the horse.  Denaesalildevil won the 11th race at the Alameda County Fair on July 1, 2006. This is a Class II violation. In accordance with the stipulated agreement, the stewards placed Dennis D. Ward on probation for one year and stayed 30 days of the 60-day suspension on condition that he has no Class 1, 2, or 3 violations during the term of the probation. The 30-day suspension began April 18 and concludes May 17. The stewards disqualified Denaesalildevil and ordered a redistribution of the purse.

In accordance with a stipulated agreement between the CHRB and trainer Wesley A. Ward, the stewards at Bay Meadows suspended Wesley A. Ward for 60 days and fined him $25,000 for violation of CHRB Rules 1843 (a) (b) (c) and 1887 after Denaesalildevil tested positive for phentermine and its metabolite hydroxyphentermine. Denaesalildevil won the 11th race at the Alameda County Fair on July 1, 2006. This is a Class II violation. In accordance with the stipulated agreement, the stewards placed Wesley A. Ward on probation for one year and stayed the 60-day suspension on condition that he has no Class 1, 2, or 3 violations during probation.

The CHRB filed a complaint against trainer Jerry Hollendorfer for violation of CHRB Rules 1843 (a) (d), 1859,5, and 1887 after a horse in his care, Dixie Crisp, tested positive for scopolamine, a Class 3 violation. Scopolamine is an anticholinergic drug that is also the toxic agent in the poisonous plant Jimson weed. Dixie Crisp finished first in the eighth race at Bay Meadows on February 19, 2007. A hearing date has not been set.

April 12

In accordance with a stipulated agreement between the CHRB and Karen Haverty, the stewards at Bay Meadows fined the trainer $3,000 for violation of CHRB Rules 1843 (a, d), 1843.6 (d) (1) (2), and 1887 after a horse in her care, Red Seattle, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Red Seattle finished fourth in the fifth race at Sonoma County Fair on July 30, 2006. The stewards disqualified Red Seattle and ordered a redistribution of the purse. Pursuant to the stipulated agreement, the stewards stayed the $3,000 fine, provided Haverty has no additional Class 1, 2, or 3 violations for one year.

March 31

The CHRB filed a complaint against trainer Oscar Garcia for violation of CHRB Rules 1843 (a) (d) and 1887 after the Kenneth Maddy Laboratory reported a positive for cetirizine and hydroxyzine in the sample taken from Super Harmony after the horse finished second in the first race at Santa Anita Park on January 28, 2007. Truesdail Laboratories confirmed the split sample. Hydroxyzine is a medication prescribed for chronic allergies. Cetirizine is a pharmacologically active metabolite of hydroxyzine. This is a Class 3 violation. A hearing date has not been scheduled.

March 24

In accordance with a stipulated agreement between the CHRB and Rene Amescua, the stewards at Santa Anita Park fined the trainer $1,500 for violation of CHRB Rules 1843 (a) and 1887 after a horse in his care, At a Boy Luther, tested positive for scopolamine - an anticholinergic drug that is also the toxic agent in the poisonous plant Jimson weed. This was a Class 3 violation. At a Boy Luther finished second in the fourth race at Hollywood Park on December 1, 2005. The stewards disqualified At a Boy Luther and ordered a redistribution of the purse. Pursuant to the stipulated agreement, the stewards stayed the fine, provided Amescua has no additional Class 1, 2, or 3 violations for one year.

In accordance with a stipulated agreement between the CHRB and Kevin Lewis, the stewards at Santa Anita Park fined the trainer $1,500 for violation of CHRB Rules 1843 (a) and 1887 after a horse in his care, Bless Idbyour Name, tested positive for scopolamine, a Class 3 violation. Bless Idbyour Name finished first in the sixth race at Del Mar on August 21, 2005. The stewards disqualified Bless Idbyour Name and ordered a redistribution of the purse. Pursuant to the stipulated agreement, the stewards stayed the fine, provided Lewis has no additional Class 1, 2, or 3 violations for one year.

The CHRB filed a complaint against trainer Gary Stute for violation of CHRB Rules 1843 (a) (d), 1843.1 (a) (b),1843.6 (d) (1) (2), 1859.5, and 1887 after a horse in his care, Theory, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). March 15

In accordance with a stipulated agreement between the CHRB and Mike Mitchell, the stewards at Santa Anita Park fined the trainer $5,000 for violation of CHRB Rules 1843, 1843.6 (d) (1) (2), and 1887 after a horse in his care, Dynout, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Dynout finished second in the sixth race at Hollywood Park on November 19, 2006. The stewards disqualified Dynout and ordered a redistribution of the purse. Pursuant to the stipulated agreement, the stewards stayed $2,000 of the fine, provided Mitchell has no additional Class 1, 2, or 3 violations for one year.

In accordance with a stipulated agreement between the CHRB and Paul Aguirre, the stewards at Santa Anita Park fined the trainer $3,000 for violation of CHRB Rules 1843, 1843.6 (d) (1) (2), and 1887 after a horse in his care, Jasjonjake, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Jasjonjake finished seventh in the 2nd race at Santa Anita on February 5, 2006. 

The stewards at Cal Expo issued a $1,500 fine to trainer J.R. Nicholson for violation of Rules 1843 (d) and 1887 after the Kenneth Maddy Laboratory at UC Davis reported that a sample from a horse in his care, Black Shoals, contained 4-hydroxypropranolol, a metabolite of propranolol. Propranolol is a beta-2 adrenergic blocking agent occasionally used in humans for hypertension. This was a Class 3 violation. Black Shoals finished in a dead heat for first in the 10th race at Cal Expo on November 4, 2006.  The stewards disqualified Black Shoals and ordered a redistribution of the purse.

March 7

In accordance with a stipulated agreement between the CHRB and Brian Pitnick, the stewards at Bay Meadows fined the trainer $3,000 for violation of CHRB Rules 1843 (d), 1843.6 (d) (1) (2), and 1887 after a horse in his care, Theycallme Mr. Tim exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Theycallme Mr. Tim finished fourth in the 10th race at the San Mateo County Fair on August 20, 2006. In accordance with the stipulated agreement, Pitnick is placed on probation for a period of one year with the fine stayed, provided he has no further Class 1, 2, or 3 medication violations during the term of probation. The stewards disqualified Theycallme Mr. Tim and ordered a redistribution of the purse.
 

February 17

In accordance with a stipulated agreement between the CHRB and Antonio Soto, the stewards at Golden Gate Fields fined the trainer $3,000 for violation of CHRB Rules 1843 (a, d), 1843.6 (d), and 1887 after a horse in his care, Trinni, exceeded the regulatory threshold of 37.0mml/l for total carbon dioxide (TCO2). This was a Class 3 violation. Trinni finished eighth in the seventh race at the San Mateo County Fair on August 9, 2006. In accordance with the stipulated agreement, Soto is placed on probation for a period of one year with the fine stayed, provided he has no further Class 1, 2, or 3 medication violations during the term of probation.

January 26

In accordance with a stipulated agreement between the CHRB and Art Sherman, the stewards at Golden Gate Fields fined the trainer $3,000 for violation of CHRB Rules 1843 (a, d) and 1887 after a horse in his care, Fargoabargain, tested in excess of the permitted level for clenbuterol. This was a Class III violation. Fargoabargain finished first in the fourth race at Bay Meadows on May 14, 2006. The stewards ordered a redistribution of the purse.

January 17

In accordance with a stipulated agreement between the CHRB and the licensee, the stewards at Golden Gate Fields issued a $6,500 fine to trainer Troy Bainum for violation of Rules 1887 and 1843 (a,d) after two horses in his care tested in excess of the permitted level for albuterol, a Class 3 medication. Albuterol is a bronchodilator. Salty M.D. ran fifth in the fourth race at the San Joaquin County Fair on June 24, 2005. Easy Pickins finished first in the fifth race at the Alameda County Fair on July 9, 2005. The stewards disqualified both horses and ordered the redistribution of the purses.

The stewards at Santa Anita Park suspended pony rider Tashina Boehnlein for one year for violation of Rules 1890 (Possession of Contraband) and 1902 (Conduct Detrimental to Horse Racing) following a hearing on a complaint filed by the CHRB alleging Boehnlein handed jockey Carlos Bautista an electrical device to shock a horse during the warm-up period prior to the start of the second race at Fairplex Park on September 24, 2006. It was further alleged that Bautista handed the device back to Boehnlein before the start of the race. The stewards earlier suspended Bautista for one year, which is under appeal.

January 12

The CHRB filed a complaint against trainer John Sadler for violation of Rules 1843 (a) (d) and 1887 (a) after a horse in his care, Cat and a Half, which finished first in the first race at Hollywood Park on November 11, 2006, tested positive for hydroxyzine and cetirizine in the post-race urine sample. The Maddy Laboratory at U.C. Davis, which is the CHRB's official laboratory, reported the findings, which were confirmed by Pennsylvania Equine Toxicology and Research Laboratories testing of the split sample. Hydroxyzine is a medication prescribed for chronic allergies; cetirizine is a pharmacologically active metabolite of hydroxyzine. This is a Class 3 violation. A hearing has not been scheduled.

The CHRB filed two complaints against trainer Vladimir Cerin for violation of Rules 1843 (a) (d) and 1887 (a) after two horses in his care tested positive for norpseudoephredrine and phenylpropanolamine. One of the horses, North Fleet Street, finished first in the 12th race at the Los Angeles County Fair on September 25, 2006, while the other horse, Off the Richter, finished third in the fifth race at the Los Angeles County Fair on September 10, 2006. The Maddy Laboratory reported the findings. Iowa State University tested the split sample and confirmed the finding for North Fleet Street. Norpseudoephredrine and phenylpropanolamine can be found in urine samples after the ingestion of herbal products containing ephedra and in several over-the-counter products for both horse and human respiratory conditions. These are Class 3 violations. Hearings have not been scheduled.
Rule 1859.25 (f) requires the CHRB to keep the results of an adverse finding by the official laboratory confidential until confirmed by the split sample laboratory. 

January 4

In accordance with a stipulated agreement between trainer Robley Johnson and the California Horse Racing Board, the Cal Expo stewards fined Johnson $3,000 for violation of Rules 1843(d), 1843.6 (d) (1 & 2) and 1887 (a) after the horse Red Star Best exceeded the regulatory threshold of 37.0mm1/1 for total carbon dioxide (TCO2). Red Star Best ran third in the seventh race at Cal Expo on March 3, 2006. This was a Class 3 violation. The stewards disqualified the horse and ordered a redistribution of the purse.
